To determine if the vehicle\u2019s emission system is in compliance, or exempt from, California regulations, all 2003 and newer year model OHV must be verified.<\/p>\n\n\n\n<p>New and Used OHVs Defined\u2014New OHVs are vehicles that have not been previously registered or operated by a prior owner in another state before being purchased by a California resident. Used OHVs are vehicles that have been previously registered or operated by a prior owner in another state.<\/p>\n\n\n\n<p><strong>The following must be submitted:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Proof of ownership. This may be&nbsp;<strong>any one<\/strong>&nbsp;of the following:<br>\u2014 An Application for Registration of New Vehicle (REG 397) form, if sold by a California dealer. The frame and engine numbers&nbsp;<strong>must&nbsp;<\/strong>be shown for motorcycles and all-terrain vehicles (ATVs).<br>\u2014 A completed <a href=\"https:\/\/www.dmv.ca.gov\/portal\/file\/application-for-title-or-registration-reg-343-pdf\/\" target=\"_blank\" rel=\"noreferrer noopener\">Application for Title or Registration (REG 343) (PDF)<\/a> form&nbsp;<strong>and&nbsp;<\/strong>nonresident requirements.<br>\u2014 The Manufacturer\u2019s Certificate\/Statement of Origin (MCO\/MSO)&nbsp;<strong>endorsed&nbsp;<\/strong>to the nonlicensed dealer&nbsp;<strong>or&nbsp;<\/strong>the original or certified copy of the factory invoice to the nonlicensed dealer&nbsp;<strong>and&nbsp;<\/strong>any bills of sale needed to establish a complete chain of ownership to the applicant. A <a href=\"https:\/\/www.dmv.ca.gov\/portal\/file\/statement-of-facts-reg-256-pdf\/\" target=\"_blank\" rel=\"noreferrer noopener\">Statement of Facts (REG 256) (PDF)<\/a> form may be accepted in lieu of a MCO\/MSO or factory invoice for a vehicle valued at $5,000 or less, as shown on the <a href=\"https:\/\/www.dmv.ca.gov\/portal\/file\/application-for-title-or-registration-reg-343-pdf\/\" target=\"_blank\" rel=\"noreferrer noopener\">REG 343 (PDF)<\/a>. A motor vehicle bond and <a href=\"https:\/\/www.dmv.ca.gov\/portal\/file\/statement-of-facts-reg-256-pdf\/\" target=\"_blank\" rel=\"noreferrer noopener\">REG 256 (PDF)<\/a> are required if the vehicle is valued over $5,000 and proof of ownership&nbsp;<strong>cannot&nbsp;<\/strong>be furnished.<br>\u2014 A business invoice with the name and address of a California nondealer.<\/li>\n\n\n\n<li>A completed <a href=\"https:\/\/www.dmv.ca.gov\/portal\/file\/application-for-title-or-registration-reg-343-pdf\/\" target=\"_blank\" rel=\"noreferrer noopener\">Application for Title or Registration (REG 343) (PDF)<\/a> form, if a REG 397 is&nbsp;<strong>not&nbsp;<\/strong>submitted.<\/li>\n\n\n\n<li>A <a href=\"https:\/\/www.dmv.ca.gov\/portal\/file\/verification-of-vehicle-reg-31-pdf\/\" target=\"_blank\" rel=\"noreferrer noopener\">Verification of Vehicle (REG 31) (PDF)<\/a> form,&nbsp;<strong>unless&nbsp;<\/strong>a REG 397 is submitted.<\/li>\n\n\n\n<li>Fees due.<\/li>\n<\/ul>\n\n\n\n<p><strong>The procedures below must be followed:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Determine if the OHV qualifies for issuance of a green sticker as follows:<\/li>\n<\/ul>\n\n\n<body><figure class=\"wp-block-table\"><table><tbody><tr><th scope=\"col\">If the OHV Is a<\/th><th scope=\"col\">Then the OHV<\/th><\/tr><tr><td><span class=\"mobile-title\">If the OHV Is a<\/span><strong>2002 or older<\/strong>\u00a0year model vehicle<\/td><td><span class=\"mobile-title\">Then the OHV<\/span><strong>Can\u00a0<\/strong>be registered and issued a green sticker.<\/td><\/tr><tr><td><span class=\"mobile-title\">If the OHV Is a<\/span><strong>2003 or newer<\/strong>\u00a0year model vehicle with an emission label indicating compliance with California regulations for off-road vehicles\u00a0<strong>or\u00a0<\/strong>on-highway use<\/td><td><span class=\"mobile-title\">Then the OHV<\/span><strong>Can\u00a0<\/strong>be registered and issued a green sticker.<\/td><\/tr><tr><td><span class=\"mobile-title\">If the OHV Is a<\/span><strong>2003 or newer<\/strong>\u00a0year model vehicle with an emission label indicating it meets or complies with U.S. EPA standards only for on-highway use<\/td><td><span class=\"mobile-title\">Then the OHV<\/span><strong>Can be<\/strong>\u00a0registered and issued a green sticker\u00a0<strong>unless\u00a0<\/strong>it is a California noncertified refusal as explained in the California Noncertified and Direct Import Vehicles Registration Refusals.<\/td><\/tr><tr><td><span class=\"mobile-title\">If the OHV Is a<\/span><strong>2003 or newer<\/strong>\u00a0year model vehicle that does\u00a0<strong>not\u00a0<\/strong>have an emission label<\/td><td><span class=\"mobile-title\">Then the OHV<\/span>Cannot be registered and issued a green sticker unless:<br>It was brought into California new or used by a nonresident and registered to that owner.The owner qualifies for an exemption, as explained in California Noncertified and Direct Import Vehicles Exemptions.<\/td><\/tr><tr><td><span class=\"mobile-title\">If the OHV Is a<\/span>2003 or newer year model vehicle with a \u201c3\u201d or \u201cC\u201d in the eighth position of the vehicle identification number,<br><strong>Note<\/strong>: Street-legal motorcycles with a \u201c3\u201d or \u201cC\u201d in the eighth position may be registered if assigned the correct<br>on-highway type license code<\/td><td><span class=\"mobile-title\">Then the OHV<\/span>Is\u00a0<strong>noncomplying\u00a0<\/strong>and\u00a0<strong>cannot\u00a0<\/strong>be issued a green sticker. Refer to the Registration of Noncomplying OHVs section in this chapter for procedures.<\/td><\/tr><tr><td><span class=\"mobile-title\">If the OHV Is a<\/span>Vehicle sold new on or after January 1, 2008, which bears a small off-road engine (SORE) label<\/td><td><span class=\"mobile-title\">Then the OHV<\/span><strong>Cannot\u00a0<\/strong>be registered.<br><strong>The procedures below must be followed:<br>Refuse\u00a0<\/strong>the registration application.<br>Copy the documents, and return the originals to the customer. Fax the copies to the Technical Compliance Section (TCS) at (916) 657-6763 with a Statement of Facts (REG 256) form stating, \u201cRegistration refused SORE label.\u201d<br>Refer to California Noncertified and Direct Import Vehicles Registration Refusals.<\/td><\/tr><\/tbody><\/table><\/figure>\n<\/body>\n\n\n<ul class=\"wp-block-list\">\n<li>Collect the fees and use tax, if due. Refer to Appendix 1F.<br>\u2014 The motorcycle cross index fee\u00a0is <strong>not<\/strong>\u00a0due for OHV motorcycles.<br>\u2014 The nonresident service fee\u00a0is<strong> not<\/strong>\u00a0required for OHV registration.<\/li>\n<\/ul>\n\n\n\n<p><strong>Direct Import Motorcycles<\/strong>\u2014A direct import is considered&nbsp;<strong>new&nbsp;<\/strong>if it enters California or is obtained by a California resident before it is two years old.
