Yacht\/ship brokers and \u201cfor hire\u201d operators are licensed by: <cite class=\"dmv-citation\">(CHNC \u00a7701a)<\/cite><\/p>\n\n\n\n<p>California State Parks Division of Boating and Waterways<br>1629 \u201cS\u201d St.<br>Sacramento, CA 95814-7291.<\/p>\n\n\n\n<p><strong>Brokers Authorized as Vessel Agents<\/strong>\u2014may collect the registration fees and use tax due or collect the registration fees only and DMV headquarters will collect the use tax due from the buyer.<\/p>\n\n\n\n<p><strong>Brokers Not Authorized as Vessel Agents\u2014must<\/strong>&nbsp;give the documents to the buyer. The registration fees and use tax are collected by DMV.<\/p>\n\n\n\n<p><span role=\"region\" class=\"format-label--note\"><span class=\"format-label__text\">Note<\/span> When an applicant claims they paid use tax to the broker, have them complete a Statement of Facts (REG 256) which explains that. Send the application to the Vessel Section in Registration Processing Unit (RPU) II in DMV headquarters.<\/span><\/p>\n\n\n\n<p><strong>The following must be submitted:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The same document\/clearance requirements for yacht\/ship broker sales as for other nondealer transactions.<br>\u2014 A bill of sale from the yacht\/ship broker to the buyer\u00a0is<strong> not\u00a0<\/strong>required.<br>\u2014 The broker\u2019s name\u00a0is<strong> not\u00a0<\/strong>entered on the back of the Certificate of Ownership.<\/li>\n\n\n\n<li>Use tax rather than sales tax.<br>\u2014 A Vessel Dealer or Manufacturer Sales Tax Certification (BOAT 110) form&nbsp;<strong>must&nbsp;<\/strong>be submitted with the application if the broker collected use tax from the buyer.<\/li>\n<\/ul>\n\n\n\n<p><strong>The procedures below must be followed:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Return applications for payment of use tax due to the legal owner\/lienholder, if any, or to the registered owner,&nbsp;<strong>not&nbsp;<\/strong>the broker.<\/li>\n\n\n\n<li><strong>For motorized vessels<\/strong>\u2014issue one set of Vessel Carbon Monoxide Warning Stickers and companion brochure with\u00a0<strong>every\u00a0<\/strong>completed renewal transaction.
