Application Requirements for Autonomous Vehicle Tester Program

Pursuant to California Vehicle Code Section 38750, a manufacturer of autonomous technology must apply to the Department of Motor Vehicles, and be approved to test a vehicle in autonomous technology mode on public roads. The Occupational Licensing Branch is currently accepting applications for an Autonomous Vehicle Testing Permit. Refer to OAL File Number 2013-1113-02 available at: Regulatory Actions.

  • If filing as a Corporation, Limited Liability Company or Limited Liability Partnership owned businesses only: A copy of Articles of Incorporation, Corporate Minutes or other document filed with the Secretary of State, which identifies the officers, shareholders and managers.

Vehicle Registration Requirements

Vehicles not operating under manufacturer or distributor plates, issued by Occupational Licensing or a state where a reciprocal agreement exists, are required to have current California registration. The following additional documents are required to register autonomous test vehicles (AV) pursuant to California Code of Regulations Section 227.48 and 227.50:

  • The California Certificate of Title or if lost, an Application for Duplicate or Paperless Title (REG 227 (PDF)).
  • A Statement of Facts (REG 256 (PDF)) from the manufacturer that certifies:
    • The AV will be operated for testing purposes only.
    • A brief description of the autonomous technology or features integrated into the vehicle and the functional capabilities made possible by this technology.
  • A Brake and Light Adjustment Certificate issued by an entity licensed by the California Bureau of Automotive Repair.
  • A smog certificate issued by an entity licensed by the California Bureau of Automotive Repair or permit issued pursuant to Health and Safety Code section 43014.

Disposal of Test Vehicles

Per CCR 227.50 there are restrictions on the sale, transfer, or disposal of test vehicles. Upon completion of testing autonomous test vehicles can only be lawfully transferred or disposed of as follows:

  • To another manufacturer holding a valid AVT Manufacturer's Testing Permit.
  • To an auto dismantler, after a  Nonrepairable Vehicle Certificate is obtained.
  • An educational or research institution or a museum for display or study.

Annual Application Fees

The fees to become an autonomous vehicle tester are:

  • $150 Non-refundable application fee

Note: The annual fee includes permits for 10 vehicles and 20 drivers/operators per application. An additional permit fee of $50 is required to add an additional 10 vehicles and 20 drivers/operators to a testing permit.

Note: Processing times may vary depending on the volume of applications received; however, the department strives to respond to all applications within 30 days.

Program Participant Accident Reporting

Pursuant to California Code of Regulations Section 227.44, a manufacturer shall report any accident originating from the operation of the autonomous vehicle that resulted in property damage, bodily injury or death within 10 days. The following form is provided to facilitate compliance with this regulation:

Program Participant Annual Reporting of Disengagement

Pursuant to California Code of Regulations Section 227.46, a manufacturer shall retain data related to the disengagement of the autonomous mode caused by the failure of the technology or when the safe operation of the vehicle requires the test driver to take immediate manual control of the vehicle. Data shall be reported annually by January 1st of each year, which summarizes the prior month(s) specified activities.
A form is not provided by the department; however, the report should summarize the following:

  • The total number of disengagements
  • The circumstances or testing condition at the time
  • The location or environment (i.e. highway, rural, parking facility)
  • A brief description can include weather conditions, roadway, etc.
  • The total number of miles each vehicle traveled in autonomous technology mode on public roads.
  • The period of time elapsed from when the autonomous vehicle test driver was alerted of the failure and the when driver assumed manual control of the vehicle.
